One of the functions of highnoonentertainment.com (the Website) is to facilitate the exchange of information between High Noon Productions LLC, its parent, subsidiary, and affiliated entities (collectively “High Noon” and “we”, “us”, “our”), and the on-line public (collectively “users” and “you”, “your”). The following is a description of the types of user information High Noon may collect via the Website, and how it may use such information.

Information Collection and Use by High Noon via the Website:

Participant Application Information

High Noon may from time to time solicit users who wish to be considered as participants in television programming produced by High Noon and/or third party producers (collectively “Producers”) to submit on-line applications for such participation. The information collected via such applications may vary from application to application, but will generally include personal information such as name, email address, street address, telephone number, fax number, and similar contact information, age, interests, gender, education, and occupation. In addition to such general information, High Noon may collect specific personal information regarding an applicant's suitability to participate in a particular program. For example, in an application to participate in a television series about home remodeling, High Noon may collect detailed information about the applicant's home, how the applicant may wish to improve the home, etc. In an application to participate in a television series about adults living with their parents, High Noon may collect information about how long the applicant has lived with their parents, why they do not have their own home, their aspirations about their living situation, etc. The foregoing are examples only, and shall not be construed to limit the types of personal information that High Noon may collect with regard to applications for any program. In addition, High Noon may collect photographs and/or video of applicants. All of the foregoing information shall be referred to herein as “Participant Application Information”.

The Website is not directed to children under the age of 13, and in the event High Noon is casting a television series involving such children, it will not solicit any such children directly but will rather solicit their parent(s) or legal guardian(s) (e.g., “Are your children particularly talented?” or “Is your family known as a �nerdy' family?”). Further, it is High Noon's policy not to accept any Application Information from a child under the age of 13, or from any person under the age of 18, without an accompanying signed parental consent from a parent or legal guardian. In the event High Noon learns that it has collected personal information from a child under the age of 13 without verification of parental consent, High Noon will delete the information as quickly as possible. High Noon recommends that minors 13 years of age or older ask their parents for permission before sending any information about themselves to anyone over the Internet.

Participant Application Information is used to evaluate an applicant's potential suitability for participation in the applicable television programming, and may also be used in and/or in connection with High Noon's television programs and/or the advertising, promotion, exhibition and other exploitation thereof. Participant Applicant Information may be shared with agents, contractors, and employees of High Noon and Producers, as well as any other persons or entities involved in and/or in connection with the development, pre-production, production, post-production, exhibition, promotion, and/or exploitation in any media of the applicable television programming (all of the foregoing referred to collectively as “Program Personnel”). Further, an applicant's contact information may be used to facilitate further contact between any Program Personnel and the applicant. Please note that any application posted on the Website may contain additional terms with regard to the use of Participant Application Information submitted via that application. In the event of any inconsistency or conflict between the terms of any application and the terms of this Privacy Policy or the Terms of Use, the terms of the application shall control.

Other Information

High Noon reserves the right to record and log non-personally-identifiable information including IP address, profile information, aggregate user data, and browser type, from users and visitors to the site (collectively “Visitor Information”). Such data may be used, among other things, to manage the Website, track usage and improve the Website services. This non-personally-identifiable information may be shared with third-parties to provide more relevant services and advertisements to users. In no manner limiting the foregoing, High Noon reserves the right to record IP addresses for security and monitoring purposes.

Use of Cookies

Cookies are pieces of information that a website sends to a user's computer while the user is viewing the website. High Noon and other companies may use cookies for a variety of purposes. High Noon reserves the right to use cookies to store users' and visitors' preferences and to record session information, for purposes including customizing advertising and Website content based on browser type and user profile information. High Noon does not link the information it may store in cookies to any personally identifiable information you submit while on the Website. High Noon may post links to third party websites on the Website. High Noon is not responsible for the privacy policies and/or practices on other sites. When linking to another site a user should read the privacy policy stated on that site. High Noon's privacy policy only governs information collected on the Website.

Third Party Advertising

High Noon may allow third party advertisers to post ads on the Website. Any advertising appearing on the Website may be delivered to users by High Noon or one of its Web advertising partners. High Noon's Web advertising partners may set cookies. These cookies allow the ad server to recognize your computer each time they send you an online advertisement. In this way, ad servers may compile information about where you, or others who are using your computer, saw their advertisements and determine which ads are clicked on. This information allows an ad network to deliver targeted advertisements that they believe will be of most interest to you. This privacy statement covers the use of cookies by High Noon and does not cover the use of cookies by any advertisers.

Information posted to Message Boards and Other Public Forums

Please be aware that whenever you voluntarily post public information to a message board and/or any other public forum on the Website, that information can be accessed by the public and can in turn be used by any member of the public for any purpose, including without limitation to send you unsolicited communications.

Security, Confidentiality and Ownership

Please note that we cannot guarantee the security of Participant Application Information or any other personal information submitted to High Noon by a user of the Website. Any person submitting personal information via the Website, including without limitation Participant Application Information, assumes the risk that the information may be viewed by persons other than Program Personnel. As stated in our Terms of Use, High Noon discourages you from sending us any information or material that you consider to be confidential or proprietary through the Website. Please note that if you do send us any such information or material, High Noon will assume it is not confidential and will not treat it as confidential. Any information or material you submit via the Website shall become the property of High Noon, and by your submission you hereby assign, for no compensation, payment, remuneration, or promise of compensation, payment, or remuneration, all right, and interest to such information and material, including any moral rights, to High Noon. In the event that you cannot assign all right, title and interest to the information or material you submit, by sending High Noon information or material, you grant High Noon an unrestricted, irrevocable license to use, reproduce, display, perform, modify, transmit and distribute those materials or information, including any moral rights, via any and all means now known or hereafter invented throughout the universe in perpetuity, and you also agree that High Noon is free to use any ideas, concepts, know-how, or techniques that you send us for any purpose without compensation, payment, remuneration, or promise of compensation, payment, or remuneration to you or any other person.

Sharing and Disclosure of Information

In addition to the uses and disclosures described above, High Noon may disclose Participant Application Information to third parties if it believes that disclosure is necessary: (1) to conform to legal requirements or to respond to a subpoena, search warrant or other legal process received by High Noon, whether or not a response is required by applicable law; or (2) to enforce the High Noon Terms of Use or otherwise to protect our rights. High Noon reserves the right to transfer Participant Application Information to a successor in interest that acquires rights to that information as a result of the sale of High Noon or substantially all of its assets to that successor in interest. Nothing in this paragraph shall be read to require High Noon to keep confidential any information submitted to High Noon via the Website, or to require any third party to keep such information confidential.

Changes in Our Privacy Policy

From time to time we may make changes to our privacy policy. If we make changes, we will post them on the Website to make users aware of what the changes are so users will always be aware of what information we collect, how we use it, and when we may disclose it. A user is bound by any minor changes to the policy when she or he uses the Website after those changes have been posted. If, however, we are going to use users' personally identifiable information (i.e., individually identifiable information about the user such as name, address, e-mail address, telephone number, social security number, etc.) in a manner materially different from that stated in the Privacy Policy at the time of collection, we will notify users by posting a notice on the Website for 30 days.
